Spencer Permanent Injunction Order 11.04.2024
On November 4, 2024, the Hon. John L. Sinatra, Jr. signed a “Stipulated Order for Permanent Injunction” in favor of the plaintiffs, including His Tabernacle Family Church and the Rev. Michael Spencer, against enforcement by the defendants, including the NYS Police, of the prohibition under NY Penal Law section 265.01-e(c.) for carrying firearms in houses of worship.
The plaintiffs are a “prevailing party” by virtue of this order, and are entitled to an award of attorney’s fees and costs under 42 USC section 1988. They have 60 days to submit their attorney fee application. The court will set the award.
