Case No.: 1:22-cv-00003. Filed 10.24.2023.
NOTE: Counsel for the Defendants NYC and NYPD filed notice of an appeal to the Second Circuit Court of Appeals on 10.25.2023, concurrently with filing a letter request for a stay of the judgment pending appeal.
The Order grants via summary judgment a permanent injunction on the merits in favor of the plaintiff, Mr. Joseph Srour, against the New York City Code provisions 10-303(a)(2) and (a)(8), which allowed licensing officers to decide firearms permits on the “good moral character” of the applicant. This decision applied NYSRPA v. Bruen (2022), finding that the NYC code provisions “…suffer from the very same constitutional flaws under Bruen.”
Plaintiff represented by Attorney Amy Bellantoni (Scarsdale, NY).
